Some states function under the fault-based system wherein, in a vehicular accident, it has to be determined which party is at fault. But there is a major loophole in this traditional system: Long legal battles on determining the at-fault party.

Now, some states tried to lessen this problem by functioning under the no-fault auto insurance system. In this system, when you get to a vehicular accident, your car insurance provider shall be the one to pay for the repair of damages or for medical bills regardless of who is at fault but only up to a specified limit of amount. But in return for this guaranteed coverage, you will have to give up certain rights to legally go after the party that is involved in the accident. And, of course, it is equal footing because you are also protected against being sued in case you are the one who is at-fault.

In a pure no-fault car insurance system, the car insurance company that provides you with coverage shall pay for all the monetary damages, such as medical bills and repairs, but it shall depend on the limits of your policy with them. You will also be forbidden to press charges for non-monetary damages, such as pain and suffering.

In any case, no state right now is under the pure no-fault car insurance system. All the thirteen states under the no-fault system (Colorado, Kentucky, Hawaii, Kansas, Massachusetts, Pennsylvania, New York, Michigan, Florida, Minnesota, New Jersey, North Dakota and your state of Utah) function in a modified way. All monetary damages are covered up to the limit, but you will now have the right to sue for non-economic damages but only up to some extent.
